Terms and Conditions

1. Seller

This online shop, Select (the "Shop"), is operated by Gola Services SUARL ("Gola Services", "we", "us"), tax ID (MF) 1479457S, whose registered address is also its office: R-11, 61 Rue Ibn Mandhour, Cité Ennozha, 2080 Ariana, Tunisia. Phone: +216 71 709 333. Email: contact@gola.tn.

2. Scope and acceptance

  • These terms apply to every sale made through the Shop between Gola Services and the person who orders (the "Customer"), whether a consumer or a business.
  • Placing an order means that the Customer has read and fully accepted these terms. The Customer's own terms do not apply unless we have accepted them in writing.
  • These terms are published in French, English and Arabic. If the versions differ, the French version prevails.

3. Products, information and prices

  • We describe our products as accurately as we can from the manufacturers' information. Images are illustrative.
  • Prices are in Tunisian dinars (TND) and include VAT. Delivery costs are not included in the product price; they are shown at checkout before the order is confirmed. The invoice may include the fiscal stamp duty required by law.
  • The price that applies is the one displayed when the order is placed.
  • If a price or a product description is obviously wrong, we may cancel the order before it ships and refund anything already paid.
  • Products are sold subject to availability. If a product turns out to be unavailable, we will tell you without delay and either cancel that part of the order or propose an alternative, and refund anything already paid for it.

4. Orders

  • The Customer is responsible for the accuracy of the details given (name, address, phone number and, for businesses, tax ID).
  • The email sent after the order only acknowledges receipt. The contract is formed when we confirm the order (by email, phone or message) or ship it.
  • We may refuse or cancel an order for a legitimate reason, in particular: a product that is out of stock, an obvious pricing error, incorrect or unreachable contact details, a payment that is not received, or a suspected fraud. We refund anything already paid for a cancelled order.
  • Our records of orders and payments are proof of the transactions between us.

5. Payment and invoicing

  • Methods: cash on delivery; bank transfer or bank deposit to our account, whose details are shown right after the order and sent by email (please use the order number as the transfer reference); in store, cash, cheque, card, mobile payment, deposit or transfer. Online card payment is not available yet.
  • An order paid by transfer or deposit is prepared once the payment is confirmed on our account.
  • Businesses may be invoiced with payment due within 15 days of the invoice date. Amounts not paid when due bear late-payment interest at the legal rate, and we may suspend further orders. Individuals pay on delivery or in advance.
  • An invoice is issued when the order is processed and sent to the Customer by email. A business Customer must provide its tax ID (MF) before the invoice is issued.
  • To the extent the law allows, the products remain our property until they are paid in full.

6. Delivery and pickup

  • The delivery methods, their prices and their usual delays are described on the Delivery & Shipping page, which is part of these terms. Delays are indicative and not guaranteed; a delay does not entitle the Customer to damages except where the law provides otherwise.
  • The Customer must be reachable on the phone number given. If a delivery fails because of the Customer (wrong address, unreachable, refusal), we may charge the cost of the failed delivery and of any new delivery.
  • Express delivery: the Customer pays for the products in advance and pays the taxi driver, on arrival, the delivery fee agreed with us.
  • In-store pickup: only once we have told the Customer that the order is ready, at the agreed appointment, on presentation of the order number and an identity document.
  • Delivery is hand to hand. Risk of loss or damage passes to the Customer on delivery or collection. The Customer must check the package in front of the courier or driver and must not accept a package that is damaged or open: a package accepted without reservation is treated as received in good condition. Any other problem, such as a missing item, must be reported to us within 24 hours of delivery, with photographs; after that, claims for transit damage or missing items are not accepted.

7. Returns

  • The Customer may return a product within 10 days of receiving it if it is unopened (in its original, sealed packaging), undamaged and complete with all its accessories.
  • The Customer must contact us first with the order number; we then confirm how to send the product back. The return postage is paid by the Customer.
  • We usually replace the product or give store credit. A refund is only made exceptionally, or where the law requires it.
  • Products that have been opened or damaged, and software, licences and digital codes once delivered or revealed, cannot be returned under this article. Defective products are covered by the warranty below.

8. Warranty

  • Products carry the warranty of their manufacturer or supplier. Most have a one-year warranty; some have 3 years, 5 years or a lifetime warranty. The duration that applies is confirmed on request.
  • Warranty claims go through us: contact us with the order number or the invoice, which serves as proof of purchase. We handle the claim with the supplier and seek the maximum cover available. The postage of the product is paid by the Customer.
  • The remedy is repair, replacement or store credit. A refund is rare and depends on the supplier.
  • Exclusions: damage caused by misuse, drops, liquids, power surges, opening or repair by anyone not authorised, removal or alteration of serial numbers or warranty seals, normal wear, and consumables.
  • Software warranty: software problems are covered only on computers bought from us on which we installed and configured the operating system, as shown by our records. Reformatting or resetting the operating system ends this cover. We give no software warranty on a system we did not set up or optimise. Hardware faults fall under the supplier's warranty above.

9. Liability

  • Our total liability for a product is limited to the price paid for it.
  • We are not liable for indirect or consequential loss, such as lost data, lost profit or downtime. The Customer must back up their data before handing us any device.
  • We are not liable for failures caused by events beyond our reasonable control, including carriers, banks, networks and force majeure, except where the law provides otherwise.
  • Nothing in these terms excludes or limits a liability that the law does not allow to be excluded or limited.

10. Account, reviews and intellectual property

  • The Customer keeps their login details confidential and is responsible for what is done with their account. We may suspend an account in case of abuse or fraud.
  • Reviews must be genuine, lawful and respectful. We may remove any review that is not.
  • The Shop's content (texts, images, logos, design) belongs to Gola Services or its licensors and may not be reproduced without our written permission.

11. Personal data

12. Complaints, governing law and disputes

  • For any complaint, contact us first at contact@gola.tn or +216 71 709 333 so that we can try to settle it together.
  • These terms are governed by Tunisian law.
  • A dispute that cannot be settled amicably is for the competent Tunisian courts. Disputes with a business Customer go to the courts of Ariana, where we have our registered office; a consumer keeps any right the law gives them to bring the dispute before another competent court.

13. General

  • If a provision of these terms is invalid, the others remain in force.
  • Our not enforcing a provision at a given time does not mean we waive it.
  • Notices may be given by email. We may update these terms; the version in force on the day of the order applies to that order.
